CHAPTER 70. ANIMALS

70-8. Limit on keeping of cats.
No person or persons shall keep within the Borough of Eddystone more than two cats more than six months of age.

70-19. Control of dogs on public property.
No person shall cause, suffer or allow any dog to be upon the highways, streets, alleys, walkways or any public property within the Borough of Eddystone without being attended and without being restrained by a leash or other appropriate restraining device.

70-22. Curbing of dogs required.
A person may cause, suffer and allow a dog to defecate in that area of any street or alley lying between the curblines or, where there are no curbs, in the paved area and the berm of any street or alley and in that area between the curbline or the berm and the sidewalk, provided that said person shall, immediately after the dog has deposited his feces upon said area, remove or cause to be removed in a sanitary manner all such feces so deposited, and provided that said feces shall be wrapped or enclosed and deposited in said person’s garbage or in some other place approved by the Health Officer of the Borough of Eddystone in such a manner so as not to cause an odor or a hazard to the health of any resident of the Borough.

CHAPTER 81. BRUSH, GRASS AND WEEDS

81-1. Conditions constituting nuisances.
The growth, maintenance and/or accumulation of weeds, grasses, trees, vines, bushes, hedges and/or other vegetable growth upon any lot, yard, area or tract of ground within the Borough of Eddystone is hereby declared to constitute a public nuisance whenever the same shall cause or contribute to any of the following conditions: 

  1. Encroachment upon any public sidewalk, street, highway, alley and/or any other public way to the inconvenience, danger, annoyance and/or impediment of persons legally using such public thoroughfare.
  2. Prevention of the proper clear view of the operators of motor vehicles at any intersection of public thoroughfares which may cause danger to the motor vehicular traffic on any public thoroughfare.
  3. Cause or aggravate hay fever or other allergy diseases.
  4. Cause or tend to cause the breeding or growth of mosquitoes, flies and/or other insects.
  5. Cause or tend to cause the breeding, growth or harboring of rats, mice and/or other rodents.
  6. Creation of a fire hazard.
  7. Constitute a detriment to the public health, welfare and safety of the residents of the Borough of Eddystone and to the users of the public thoroughfares of the Borough of Eddystone.

CHAPTER 92. BURNING, OUTDOOR

92-2. Restrictions of fires on private property.
Out-of-door fires shall be permitted upon private property in the Borough of Eddystone, provided that the following regulations and restrictions are strictly adhered to:

  1. Every such out-of-door fire shall be built in and confined to a noncombustible container covered with a screen of one-half-inch mesh or smaller, or other suitable noncombustible container.
  2. No such fire shall be closer than 15 feet to any building or to any property line.

CHAPTER 103. CURFEW

103-4. Curfew hours established.
It shall be unlawful for any person 17 or less years of age (under 18) to be or remain in or upon the streets within the Borough of Eddystone at night beginning at 9:00 p.m. prevailing time and ending at 6:00 a.m.

CHAPTER 191. MINIBIKES AND MOTORCYCLES

191-1. Operation Restriction
It shall be unlawful for anyone to operate a motorcycle, minibike or any other type of motor vehicle on the sidewalks, footpaths, parks or property belonging to anyone other than the operator or driver of such motor vehicle unless said operation upon the property of another is with the written permission of said owner.

CHAPTER 256. STREETS AND SIDEWALKS

256-38. Repair of vehicles on streets prohibited.
It is hereby unlawful for any person, individual, firm, corporation, association, partnership and/or other legal entity to perform any general service, general maintenance and/or general repair work on any vehicle parked upon any public street, public alley, public thoroughfare and/or public way within the Borough of Eddystone. Permitted exceptions to the aforesaid prohibition shall be emergency maintenance and/or general service which may be required to place said vehicle in an operable condition, but shall not include any repair work.

256-40. Sidewalks to be cleared.

  1. Not later than 24 hours after snow has ceased to fall, the occupant of occupied property or premises, whether commercial, industrial or residential, and the owner of any apartment house, multiple dwelling or unoccupied property or premises shall clear a path in the sidewalk upon which such property or premises abuts, which path shall be not less than 24 inches in width and shall be thoroughly cleaned of snow and ice.
  2. Snow or ice removed from sidewalks, driveways or other areas shall not be placed or piled in the gutter or streets.
  3. The failure of the occupant or owners of property, or premises, as aforesaid, to remove said snow and ice during the period as hereinabove set forth shall be deemed to be a public nuisance, and, in default of removing said ice and snow, as herein provided, the Borough may cause the same to be done and collect the cost thereof, together with a penalty of 10% of such cost, in the manner provided by law for the collection of municipal claims or by action of assumpsit with the filing of a claim.

Certificate of Occupancy

A Certificate of Occupancy is required whenever there is a change in ownership in a residential owner-occupied structure. In addition, an annual Certificate of Occupancy is required for each rental dwelling unit.

In order to assist property owners in preparing for a CO inspection, please complete the following items prior to calling for your walk-through:

GENERAL

  1. Scrape and re-paint all peeling, chipping, rusting and/or bare materials.
  2. All doors and windows must be in proper operating condition (open, close, good screens, no broken glass).
  3. Smoke alarms in all sleeping areas and one on each floor.
  4. Carbon Monoxide Detector – 15′ from sleeping area.
  5. All concrete and curbing should be in good repair.
  6. Any dead bolt lock must switch to thumb turn type.
  7. All steps with 3 or more risers must have a continuous graspable railing.
  8. 4″ contrasting house numbers on front and rear. Not on movable object.
  9. Anti-tip device on stove.
  10. All walls must be in good repair.
  11. All brick pointing must be in good repair.

HEATING & PLUMBING

  1. Heating certificate for any commercial or residential heating unit(s).
  2. All water heaters and boilers must have a relief valve discharge pipe installed 6″ from floor for safety.
  3. All piping that comes through walls, ceilings, cabinets, vanities must be sealed and escutcheons installed around piping.
  4. All tubs, showers, sinks, etc., must have strainer to protect from foreign objects from falling into plumbing systems.
  5. All abandoned appliances, heating/cooling equipment, oil tanks must be removed from any commercial or residential property.
  6. All plumbing must be in good repair. No leaks, etc.

ELECTRICAL

  1. Passing underwriters inspection of panel.
  2. All breakers must be labeled.
  3. All outlets 6′ and closer to a water source all exterior outlets must be GFCI protected.
  4. All wiring must be to code. No open boxes exposed wiring, etc.
  5. All egresses must have lights.
  6. Light covers where needed.
  7. All rooms must have lights or (1) outlet controlled by a switch.
  8. All bathrooms / powder rooms must have (1) GFCI protected outlet.

THIS LIST IS A GUIDE CONTAINING THE MINIMUM INSPECTION REQUIREMENTS.

A Use and Occupancy Certificate must be issued before occupancy can take place.

CONTRACTOR LICENSE AND REGISTRATION

Residents are reminded that all contractors performing work within the Borough limits must registered and licensed by the Borough of Eddystone. Prior to signing a contract, it is good practice to ask the contractor for references, as well as check with the Code Enforcement office to confirm that the contractor has a license in good standing on file.

RENTAL PROPERTIES

A Residential Rental Operating License is required by any person or entity leasing property in the Borough. Prior to occupancy, the property owner is required to obtain a Certificate of Occupancy, as well as a Rental Tenant Notification Form. Prior to any new accountable tenant occupying a rental unit, the leaser shall complete a new Rental Property Tenant Notification form and have the dwelling inspected.

RESIDENTIAL WORK PERMIT

A Residential Work Permit must be obtained prior to performing the following type of work:

  • Building an additional level or extension of an existing dwelling
  • Replace or repair roof and gutter drainage systems
  • Building or replacing a deck
  • Installing replacement windows or doors
  • Kitchen or bathroom renovations
  • Repairing or replacing plumbing, electrical or HVAC components
  • Installation of a pool
  • Building a garage, carport or shed
  • Building or replacing a retaining wall
  • Driveway improvements
  • Installing fencing or screening
  • Replacing or repairing concrete curb, sidewalk and/or steps

REPORTING AN UNFIT DWELLING OR ILLEGAL OCCUPANCY

Please use the forms below to make an official complaint request for unfit dwelling conditions, environmental, health and safety issues, and/or illegal occupancy of a dwelling within the Borough of Eddystone. Examples of unfit dwellings include unfit structures, electrical hazards, plumbing hazards, unfit food, accumulations of rubbish, and pest control. Individuals may also report anonymously by partially completing either of these forms.
